Leasehold Valuation Tribunals
We have considerable experience in this complicated and technical area whether you are either a freeholder or leaseholder.
Leaseholders can apply to the Leasehold Valuation Tribunal (LVT) to resolve disputes they have with their freeholder. The types of disputes that the LVT will generally consider are:

whether the service charge being demanded is reasonable

the Tenant's Right to Manage their own estate or block of apartments

the procedure for the Tenant's Right of First Refusal when the Landlord wishes to sell

the terms of extending any leases which are due to expire

compelling the Landlord to sell the freehold
Service Charges
Most people don’t appreciate that the Landlord's powers are strictly limited by the terms of the lease – for example if the Landlord has incurred an expense which is not included in the definition of Service Charge, then it may be irrecoverable. We have the expertise to review your lease and provide an opinion swiftly.
Right to Manage
Sometimes if the Landlord is not living up to its responsibilities in the Lease, the Tenant’s may decide to manage their estate or block for themselves. However, there is a strict procedure to follow. Our experience ensures that the procedure is followed correctly and efficiently.
Right of First Refusal
Most people are not aware that in many cases Landlords cannot sell their freeholds without first offering it to their leaseholders who have a statutory right of first refusal. Whilst we have experience of the procedure, we are unable to advise upon matters such as valuation. However, we have a strong network of professionals who are able to provide assistance in determining such issues which allows us to provide a complete service to you.
Renewal of Leases
If your lease has expired, or your mortgagee requires a longer term (typically longer than 75 years), then you may approach your Landlord to grant a new lease to you. Usually this will be on the same terms as the existing Lease – however, the existing lease may be outdated and require substantial amendment in order to accord to modern practice. Right to buy the Freehold
Leaseholders acting together may force the Landlord to sell the freehold to them, however, the procedure must be followed correctly and we have the expertise to ensure that neither the Landlord or Tenant fall into the traps in the legislation.
